Terms & Conditions of Booking

These Terms & Conditions apply to bookings made with Unleashed Productions Ltd (“Unleashed Productions”, “we”, “us” or “our”) for the provision of entertainment, performers, artists, productions and associated services.

By confirming a booking with Unleashed Productions Ltd, paying a deposit or other booking payment, or instructing us to proceed with a booking, the Client agrees to be bound by these Terms & Conditions together with the individual booking confirmation, quotation or contract issued for the engagement.

Where the terms of an individual booking confirmation differ from these general Terms & Conditions, the terms specifically agreed in writing for that booking shall take precedence.

1. Definitions

For the purposes of these Terms & Conditions:

“Client” means the person, company, venue, organisation or representative making the booking.

“Artist” or “Performer” means any singer, dancer, musician, tribute artist, speciality performer, actor, presenter or other entertainment professional supplied or represented by Unleashed Productions.

“Production” means any show, production, performance package or entertainment concept supplied by Unleashed Productions.

“Engagement” means the event, performance or services detailed within the booking confirmation.

“Booking Fee” means any deposit, booking payment or other initial payment required to secure the Engagement.

2. Booking Confirmation

All bookings are subject to availability and are only considered confirmed once Unleashed Productions has issued written confirmation and any required Booking Fee has been received.

Until confirmation is issued, any quotation, availability check or provisional hold should not be regarded as a confirmed booking.

The Client is responsible for checking all information contained within the booking confirmation, including:

  • event date;
  • venue;
  • performance times;
  • number of performers;
  • agreed services;
  • technical requirements;
  • access and arrival arrangements; and
  • agreed fee.

Any errors or amendments should be brought to our attention as soon as possible.

3. Prices

All prices quoted are based upon the information supplied by the Client at the time of enquiry.

Unless otherwise stated, quotations may take into account factors including performance requirements, number of performers, travel, accommodation, rehearsal requirements, technical requirements, costumes, equipment and the duration of the Engagement.

VAT will be charged where applicable.

Any material change to the original brief may result in an adjustment to the agreed fee.

This may include, but is not limited to:

  • changes to performance or call times;
  • additional performance sets;
  • extended performance durations;
  • additional rehearsals;
  • changes of venue;
  • additional travel;
  • overnight accommodation requirements;
  • additional performers;
  • additional costumes;
  • additional production or technical requirements; or
  • a substantial change to the nature or scope of the Engagement.

No additional charges will be incurred without the Client being informed where reasonably practicable

4. Payment Terms

A 20% Booking Fee is required upon confirmation of the Engagement unless otherwise agreed in writing.

The Booking Fee secures the agreed date, performers and/or production and enables Unleashed Productions to begin committing resources to the Engagement. Once a booking is confirmed, performers and resources may be reserved specifically for the Client and alternative work may subsequently be declined.

The Booking Fee forms part of the total contracted fee and will be deducted from the final balance payable.

The remaining balance must be paid in full no later than the date of the Engagement, unless alternative payment terms have been expressly agreed in writing.

Where requested by Unleashed Productions, payment may be required prior to the commencement of the performance or services on the event date.

It is the Client’s responsibility to ensure that any internal payment procedures, purchase orders or supplier onboarding requirements are completed sufficiently in advance to enable payment within the agreed timescale.

Failure to obtain an internal purchase order, approval or other administrative authorisation does not alter the Client’s contractual payment obligations.

Where payment has not been received when contractually due, Unleashed Productions reserves the right, where reasonable, to withhold or suspend the performance or services until payment has been received.

5. Cancellation by the Client

All cancellations must be made in writing.

Once an Engagement has been confirmed, Unleashed Productions reserves the agreed date, performers, production resources and/or equipment specifically for the Client. In doing so, Unleashed Productions and its performers may decline other work for the same date.

The following cancellation terms therefore apply:

More than 90 days before the Engagement

No additional cancellation charge will be payable. The 20% Booking Fee will ordinarily be retained to reflect the reservation of the date and reasonable work and commitments already undertaken in connection with the booking, subject always to applicable law.

Between 90 and 31 days before the Engagement

No additional cancellation charge will be payable beyond the Booking Fee, subject to any additional non-recoverable costs specifically incurred for the Engagement.

Between 30 and 8 days before the Engagement

50% of the total contracted booking fee will become payable.

Any Booking Fee already paid will be credited towards this amount and will not be charged in addition.

7 days or fewer before the Engagement

100% of the total contracted booking fee will become payable.

Any amounts already paid will be credited towards the total amount due.

Purpose of Cancellation Charges

Our cancellation charges are intended to reflect the losses and commitments that may reasonably arise when an Engagement is cancelled.

Our performers are professional freelance artists who reserve dates for confirmed Engagements and may turn down alternative work once contracted. Unleashed Productions may similarly decline other enquiries in order to honour a confirmed booking.

As the Engagement date approaches, the likelihood of replacing cancelled work becomes significantly reduced. Cancellation may therefore result in loss of earnings for both the contracted performers and Unleashed Productions, together with costs already incurred in preparing for the Engagement.

These may include, where applicable:

  • performer and artist commitments;
  • loss of alternative bookings;
  • rehearsals and preparation;
  • choreography and creative development;
  • bespoke music editing;
  • costume preparation or alterations;
  • production planning;
  • administration;
  • travel and accommodation commitments;
  • equipment or technical hire; and
  • other costs reasonably incurred specifically for the Engagement.

The cancellation charges above are intended to provide a reasonable framework for these anticipated losses rather than operate as a penalty.

Additional Costs Already Incurred

Where Unleashed Productions has incurred specific non-refundable or non-recoverable third-party costs at the Client’s request before cancellation — for example bespoke costume purchases, travel, accommodation, equipment hire or specifically commissioned services — these may remain payable in addition to the applicable cancellation charge where legally permitted and where they are not already included within that charge.

We will not seek to recover the same loss twice.

Rescheduled Events

Where a Client wishes to postpone rather than cancel an Engagement, Unleashed Productions will make reasonable efforts to transfer the booking to an alternative date.

Any transfer is subject to the availability of the contracted performers, artists and production personnel and must be agreed in writing.

Where the original performers or production cannot accommodate the new date, alternative performers may be offered where appropriate.

Additional costs resulting from a change of date, venue, personnel or other booking requirements may be payable.

A postponement does not automatically entitle the Client to a refund or exemption from cancellation charges.

6. Changes to an Engagement

Once a booking has been confirmed, any requested changes must be agreed by Unleashed Productions in writing.

We will make reasonable efforts to accommodate changes; however, changes remain subject to performer and production availability.

Significant changes to the event date, location, timings, performance duration, creative brief or scope of work may be treated as a variation of the original contract and may result in additional charges.

If changes are so substantial that the original Engagement can no longer reasonably be fulfilled, Unleashed Productions reserves the right to treat the change as a cancellation and rebooking.

7. Performance Times & Delays

The Client must ensure that the agreed performance schedule can be reasonably achieved.

Performers must be provided with sufficient time for arrival, preparation, costume changes, warm-up and any required technical checks.

If an event is delayed through circumstances outside the control of Unleashed Productions or its performers, we will make reasonable efforts to accommodate the revised schedule.

However, performers cannot be required to remain at an event indefinitely or substantially beyond the contracted hours.

Where performers are required to remain beyond the agreed booking period, additional fees may become payable.

Where delays mean that a performance cannot take place within the contracted period, the full agreed fee may remain payable.

8. Performance Requirements

The Client agrees to provide a safe and suitable environment for all performers and personnel.

Where applicable, this includes:

  • suitable toilets and washing facilities;
  • a clean, secure and private changing area;
  • drinking water;
  • adequate heating or ventilation;
  • safe performance flooring;
  • suitable lighting;
  • safe access to the performance area;
  • appropriate security where required;
  • sufficient performance space; and
  • access to electrical power and technical facilities where agreed.

Performers should not normally be expected to change in public areas, toilets, vehicles or other unsuitable locations.

Where a performance environment is considered unsafe, inappropriate or materially different from that agreed, Unleashed Productions and/or the Performer reserves the right to delay, modify or refuse to perform until the issue has been rectified.

9. Outdoor Performances

For outdoor Engagements, the Client must provide appropriate protection against adverse weather where reasonably required by the nature of the performance.

Certain performances, costumes, electrical equipment, props or speciality acts may not be suitable for use in rain, strong winds, extreme temperatures or other unsafe weather conditions.

The safety of performers, crew and guests will always take priority.

If weather conditions make a performance unsafe, Unleashed Productions may modify, delay, relocate or cancel the relevant element of the performance.

 

10. Technical Requirements

Where technical equipment is being supplied by the Client, venue or a third-party production company, it must meet any specifications supplied by Unleashed Productions.

The Client is responsible for ensuring that relevant technical personnel are available where required.

Unleashed Productions cannot accept responsibility for reduced performance quality or inability to perform where agreed technical requirements have not been provided.

11. Artist & Performer Substitution

Entertainment bookings involve individual professional performers and, occasionally, circumstances such as illness, injury, transport disruption or other unforeseen events may make a particular performer unavailable.

Where reasonably necessary, Unleashed Productions reserves the right to provide a suitable professional replacement of a comparable standard.

For productions involving multiple cast members, individual cast members may change without this constituting a material change to the Production.

Where the booking relates specifically to a named headline artist or tribute performer and no suitable replacement can reasonably be provided, we will discuss the available options with the Client.

12. Costumes, Choreography & Creative Content

Unless otherwise agreed in writing, all costumes, choreography, staging concepts, show formats, music edits, production concepts and other creative material supplied or created by Unleashed Productions remain the intellectual property of their respective owner(s).

Costumes and creative elements shown in promotional photographs or videos are illustrative of the quality and style of our work. Exact costumes, performers and styling may vary according to availability, sizing, performance requirements and the individual event brief.

Where specific costumes, colours or creative elements are essential to an Engagement, these must be agreed in writing prior to confirmation.

13. Photography, Filming & Social Media

Guests and Clients may take reasonable photographs and short-form video footage for personal or event-related social media use unless otherwise agreed.

Professional filming, broadcast, commercial photography, advertising campaigns, livestreaming or use of performance footage for commercial purposes must be disclosed and agreed in advance.

Additional permissions or fees may be required for commercial usage.

The Client must not use photographs, video or other content featuring Unleashed Productions or its performers in a manner that is defamatory, misleading or likely to damage the reputation of Unleashed Productions or the Performer.

14. Conduct Towards Performers

Unleashed Productions operates a zero-tolerance approach to threatening, abusive, discriminatory, intimidating or inappropriate behaviour towards its performers and personnel.

The Client is responsible for taking reasonable steps to provide a safe working environment.

Performers reserve the right to withdraw from an unsafe situation or cease performing where they are subjected to harassment, threatening behaviour, unwanted physical contact or other conduct which reasonably places their safety or welfare at risk.

Such circumstances will be assessed according to the facts of the situation and may not entitle the Client to a refund.

15. Health & Safety

Unleashed Productions and its performers will take reasonable steps to comply with applicable health and safety requirements.

The Client and/or venue remains responsible for the general safety and suitability of the premises and for informing us of any known hazards or restrictions which may affect the Engagement.

Speciality performances including fire, aerial, stilt walking and other higher-risk activities may require additional safety arrangements, risk assessments, permissions or performance space.

These requirements will be communicated where applicable.

16. Licences & Permissions

Unless specifically agreed otherwise, the Client and/or venue is responsible for obtaining any licences, permissions or approvals required for the event and venue.

This may include appropriate permissions relating to entertainment, music, fire performance, pyrotechnics, aerial performance, filming or other specialist activity.

17. Force Majeure

Neither party shall be liable for failure or delay in performing its obligations where performance is prevented by circumstances genuinely beyond its reasonable control.

Such circumstances may include severe weather, natural disaster, fire, flood, epidemic or pandemic restrictions, war, terrorism, civil disturbance, government restrictions, venue closure, significant transport disruption or other comparable events.

The affected party must notify the other as soon as reasonably practicable.

Where possible, the parties will work together in good faith to consider reasonable alternatives, including postponement, relocation, replacement performers or rescheduling.

Any costs already irrecoverably incurred prior to the Force Majeure event will be dealt with in accordance with applicable law and the circumstances of the individual booking.

18. Cancellation by Unleashed Productions

In the unlikely event that Unleashed Productions is unable to fulfil an Engagement, we will make reasonable efforts to provide a suitable alternative where appropriate.

If we cancel an Engagement and cannot provide the contracted service or a suitable agreed alternative, monies paid for the affected services will be refunded as required by applicable law.

We shall not be responsible for indirect or consequential losses arising from cancellation except where liability cannot lawfully be excluded

19. Liability

Unleashed Productions will provide its services with reasonable care and skill.

Nothing within these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to applicable law, Unleashed Productions shall not be responsible for indirect or consequential losses arising from circumstances outside its reasonable control.

For business-to-business bookings, our total liability arising from an Engagement shall not exceed the total amount paid or payable to Unleashed Productions for that Engagement, except where liability cannot lawfully be limited.

Nothing in these Terms affects a consumer’s statutory rights.

20. Third-Party Suppliers

Where Unleashed Productions arranges services provided by third parties, such as accommodation, transport, production equipment or other suppliers, those services may also be subject to the relevant supplier’s terms and conditions.

We will take reasonable care when selecting and coordinating third-party suppliers but cannot accept responsibility for matters genuinely outside our reasonable control.

21. Client Responsibility for Information

The Client is responsible for providing accurate and complete information relating to the Engagement.

This includes venue information, access restrictions, parking, performance space, timings, security requirements, technical specifications and any other information reasonably required for delivery of the Engagement.

Additional costs resulting from material information being withheld or supplied incorrectly may be charged to the Client where reasonable.

22. Promotional Material

Unless otherwise agreed, photographs, videos, descriptions and promotional material supplied by Unleashed Productions remain the property of Unleashed Productions and/or the relevant copyright owner.

Such material may not be substantially altered, reproduced for unrelated commercial purposes or used to imply an endorsement without prior permission.

23. Data Protection & Privacy

Personal information supplied in connection with an enquiry or booking will be processed in accordance with applicable UK data protection legislation and our Privacy Policy.

Information may be shared with performers, venues, production personnel and relevant suppliers where reasonably necessary to arrange and fulfil an Engagement.

24. Complaints

We take the quality of our productions and performers seriously.

Any concern arising during an Engagement should, where possible, be raised with the Unleashed Productions representative or event contact at the time so that we have an opportunity to resolve the matter.

Formal complaints should be submitted in writing as soon as reasonably practicable following the Engagement and should include sufficient information for us to investigate the matter.

25. Confidentiality

Where either party receives confidential commercial, financial, production or event information in connection with an Engagement, that information should not be disclosed to third parties except where reasonably necessary to fulfil the Engagement or where disclosure is required by law.

26. Entire Agreement

The booking confirmation, any specifically agreed written terms and these Terms & Conditions together constitute the agreement between the Client and Unleashed Productions.

Any amendment must be agreed in writing.

Failure by either party to enforce any provision of these Terms & Conditions on one occasion shall not prevent that provision from being enforced subsequently.

27. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force so far as legally permitted.

28. Governing Law

These Terms & Conditions and any dispute arising from them shall be governed by the laws of England and Wales.

Where the Client is acting in the course of business, the courts of England and Wales shall have exclusive jurisdiction.

Where the Client is acting as a consumer, nothing within these Terms & Conditions removes any rights relating to jurisdiction which the Client has under applicable consumer law.
